These Terms & Conditions govern all bookings made via www.triphistoric.com, the “Website”. Except where otherwise specified, Historvius Limited, a company registered in England & Wales, with company number 8222429, and registered office address of 1 Theobald Court, Theobald Street, Borehamwood, Hertfordshire, United Kingdom, WD6 4RN trading as “Trip Historic” (“we”, “us”, “our”) act only as an agent in respect of any and all bookings you make on or via this Website. We accept no liability in relation to any contract you enter into or for any travel arrangements or other services you purchase (“Travel Arrangements”) or for the acts or omissions of any supplier or other person(s) or party(ies) connected with any Travel Arrangements. For all Travel Arrangements, your contract will be with the operator/supplier of the Travel Arrangements in question (the “Supplier/Principal”).
By making a booking via this Website, the first named person on the booking agrees on behalf of all persons named on the booking that they:
a. have read these Terms & Conditions and agree to be bound by them;
c. are over 18 years of age and resident in the United Kingdom and where placing an order for services with age restrictions you declare that you and all members of your party are of the appropriate age to purchase those services; and
d. accept financial responsibility for payment on behalf of all persons detailed on the booking.
2. Your Booking
We develop trip itineraries featuring different types of Travel Arrangements. The Website gives you the option to book the various Travel Arrangements featured in the itinerary. Some of these Travel Arrangements, such as excursions and tickets booked with certain Supplier/Principals (such as Viatour for example), you can book and make payment for the Travel Arrangements via the Website directly to the Supplier/Principal. However, for other Travel Arrangements, you will be re-directed to the website of the Supplier/Principal to make your booking and make payment directly with the Supplier/Principal.
For all bookings, irrespective of whether payment is made via us or directly to the Supplier/Principal, you will be entered into a contract with the applicable Supplier/Principal of the Travel Arrangements. We accept no responsibility for the acts or omissions of the Supplier/Principal or for the Travel Arrangements provided by them. Your booking is subject to these Terms & Conditions and the specific terms and conditions of the Supplier/Principal you contract with and you are advised to read both carefully prior to booking. In particular, you will be subject to the Supplier/Principal’s cancellation and amendment terms and charges and you will be notified of these terms at the time of booking. The Supplier/Principal’s terms and conditions may limit and/or exclude the Supplier/Principal's liability to you.
Your booking is confirmed and a contract between you and the Supplier/Principal will exist only when we send you a booking confirmation on their behalf, or the Supplier/Principal sends you a booking confirmation directly.
Linked Travel Arrangements
You may decide to book multiple Travel Arrangements at the same time for the purpose of the same trip. However, at no point do we offer or sell multiple Travel Arrangements at an inclusive or total price. The prices for each individual Travel Arrangement are always shown as a separate charge and you will be directed to make payment separately for each individual Travel Arrangement, whether via the Website or directly to the Supplier/Principal. This means that your booking does not constitute a “Package” as defined in the Package Travel and Linked Travel Arrangements Regulations 2018 (PTRs). However, where your booking includes multiple Travel Arrangements for the purpose of the same trip and you make the booking and payment via our Website, this may be a “Type A Linked Travel Arrangement” as defined in the PTRs. This is because we have facilitated the conclusion of separate contracts between you and the individual Supplier/Principals on the occasion of a single visit to, or contact with the Website, via the separate selection and payment of each of the Travel Arrangements. However, please note that Linked Travel Arrangements are not afforded the same rights and protections under the PTRs as Packages. Please see the Information on Traveller’s Rights when booking a Linked Travel Arrangement for further information on your legal rights in relation to Linked Travel Arrangements.
The price of your booking will be displayed on the Website, and is inclusive of VAT/sales tax (unless stated otherwise on the Website, or in the Supplier/Principal’s terms and conditions). Additional fees and taxes (such as tourist/city taxes) may be charged by the Supplier/Principal in addition to the booking price, and in some cases they may be charged locally.
We reserve the right to amend advertised prices at any time. We also reserve the right to correct errors in both advertised and confirmed prices. Special note: changes and errors sometimes occur. You must check the price of your chosen Travel Arrangements at the time of making your booking. Obvious errors and mistakes (including misprints) are not binding.
In order to make a booking, you will either have to make payment on the Website, or you will be re-directed to the Supplier/Principal’s website to make payment.
Where payment is made to the Supplier/Principal via the Website, we will facilitate payment on behalf of the Supplier/Principal only and will not act or operate as the merchant of record. Payment details will be securely transferred to the relevant Supplier/Principal for payment processing. The Supplier/Principal’s details will appear on your bank or credit/debit card statement as the payee. At no point will your payment be held by us.
We have no liability to you for any charge made by the Supplier/Principal (whether authorised, (allegedly) unauthorised or wrong) in relation to your booking and you cannot claim or reclaim any charges made by the Supplier/Principal from us (including in the event of any no-show or cancellation charges being imposed by the Supplier/Principal).
We strongly recommend that you take out a policy of insurance in order to cover you and your party against the cost of cancellation by you; the cost of assistance (including repatriation) in the event of accident or illness; pre-existing medical conditions, loss of baggage and money; and other expenses.
6. Changes & Cancellations by You
If you wish to cancel or amend your confirmed booking, you must contact the Supplier/Principal directly. All amendment and cancellation requests will be dealt with in accordance with the Supplier/Principal’s terms and conditions.
Please note that there is no automatic statutory right of cancellation under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (Directive 2011/83/EU).
7. Our responsibility for your booking
Your contract for the Travel Arrangements is with the Supplier/Principal and its terms and conditions apply. As agent, we accept no responsibility for the actual provision of the Travel Arrangements. Our responsibilities are limited to making the Travel Arrangements available to book on the Website. We accept no responsibility for any information about the Travel Arrangements that is displayed on the Website in good faith. However, in the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to the price of your booking (or the appropriate proportion of this if not everyone on the booking is affected). We do not exclude or limit any liability for death or personal injury that arises as a result of our negligence or that of any of our employees whilst acting in the course of their employment.
8. Visa, passport and health requirements
Your specific passport and visa requirements, and other immigration requirements are your responsibility and you should confirm these with the relevant Embassies and/or Consulates. Neither we nor the Supplier/Principal accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements. Please note that these requirements may change between booking and departure. Most countries now require passports to be valid for at least 6 months after your return date.
Because the contract for your Travel Arrangements is between you and the Supplier/Principal, any queries or concerns about your Travel Arrangements should be addressed to them. If you have a problem with your Travel Arrangements whilst using them, this must be reported to the Supplier/Principal immediately. If you fail to follow this procedure there will be less opportunity for the Supplier/Principal to investigate and rectify your complaint. The amount of compensation you may be entitled to may therefore be reduced or extinguished as a result.
If you wish to complain when you return home, please contact the Supplier/Principal. You will see their name and contact details in any confirmation documents we send you. We will of course assist you with identifying the correct Supplier/Principal contact details if you wish - please contact us. If you wish to complain about any service we have provided to you (i.e. our booking service) then please contact us directly.
If you’re unhappy with the way your complaint has been dealt with, you can also access the European Commission Online Dispute Resolution (ODR) platform at http://ec.europa.eu/consumers/odr/, which is an alternative method of dispute resolution.
10. Law and Jurisdiction
These Terms & Conditions are governed in all respects by English law. We both agree that any dispute, claim or other matter which arises between us out of or in connection with your use of the Website and/or your booking will be dealt with by the Courts of England and Wales only. You may however, choose the law and jurisdiction of Scotland or Northern Ireland if you live in those places and if you wish to do so.
11. Accommodation Ratings and Standards
All ratings are as provided by the relevant Supplier/Principal. These are intended to give a guide to the services and facilities you should expect from your Travel Arrangements. Standards and ratings may vary between countries, as well as between suppliers. We cannot guarantee the accuracy of any ratings given.
12. Documentation & Information
All descriptions and content on our Website or otherwise issued by us is done so on behalf of the Supplier/Principal in question and is intended to present a general idea of the services and facilities provided by the Supplier/Principal. Not all details of the relevant services and facilities can be included on the Website. All services and facilities shown are subject to availability. If you require any further details, in respect of any Travel Arrangements or any other services please contact the relevant Supplier/Principal.
13. Data Protection
14. Travel Destinations
While we hope that our Website helps you find interesting historic sites around the world, we are not a travel advisory service and neither recommend nor dissuade travel to any particular destination. We make no representations as to the safety of different travel destinations or the risks involved in visiting different locations around the world, nor do we warrant that travel to any destination is without risk. We are not liable for any loss or damage, nor personal injury and death, that may result from travel to any destinations other than caused by our negligence.
We strongly advise you to check with your country’s foreign office or other relevant government body for advice and any travel warnings before considering travelling to any international destination.
